The Code on Social Security 2020: Key Changes and Their Impact

Provided further that for the purpose of equal wages to all genders and for the purpose of payment of wages, the emoluments specified in sub-clauses (d), (f), (g) and (h) shall be taken for computation of wage. An employer, if fails to pay any amount of gratuity to which an employee is entitled under this Code, will be punished with imprisonment for a term which may extend to one year or with fine which may extend to fifty thousand rupees, or with both. Temporary disablement means a condition resulting from an employment injury which requires medical treatment and renders an employee, as a result of such injury, temporarily incapable of doing the work which he was doing prior to or at the time of the injury. Gig worker means a person who performs work or participates in a work arrangement and earns from such activities outside of traditional employer-employee relationship. The employer in every establishment or any class or category of establishments, before filling up any vacancy in any employment in that establishment or such class or category of establishments, have to report that vacancy to such career centre as may be specified, and the employer should comply with such requisition. There is no obligation imposed upon any employer to recruit any person through the career centre to fill any vacancy merely because such vacancy has been reported. Every building worker who has completed eighteen years of age, but has not completed sixty years of age, and who has been engaged in any building or other construction work for not less than ninety days during the preceding twelve months shall be registered by the officer authorised by the Building Workers‘ Welfare Board as a beneficiary.

The Code also empowers the Central Government to frame suitable welfare schemes and formulate social security fund to provide social security benefits to the unorganised workers, the gig workers and the platform workers who were earlier not covered by the labour law legislations in India. Such progressive steps by the Indian Government is the need of the hour, not only to ensure that the social security benefits are rightfully extended to the vulnerable workers across all the sectors but also to protect them from any discriminatory practises and exploitation. The Code also makes Aadhaar registration on the Shram Suvidha Portal mandatory for the workers across all sectors to receive the social security benefits. However, this could surface new challenges for the Indian Government and have far reaching implications for many workers who still do not possess Aadhaar cards and hence, will be devoid of such benefits.

How Much Can I Get in Social Security Benefits?

The average retired worker’s benefit amounts to over $20,000 annually, so the program shouldn’t be relied on as your sole source of retirement income. These options include individual retirement accounts (IRAs), employer-sponsored plans such as a 401(k) or 403(b), and other savings and investments.
